Terms of Service

The rules of the road for using The View Eyewear. Plain English. No fine print games.

1. What The View Eyewear Is

The View Eyewear ("we," "us," "the site") is an independent luxury eyewear directory and marketplace operated from the State of Georgia, USA. We list optical boutiques, independent eye care practices, designer eyewear brands, and trunk shows. We are not a retailer. We do not sell eyewear directly. When you contact a boutique or brand through the site, you are entering into a relationship with that third party, not with us.

2. Subscription Plans

Boutiques and designer brands may list for free or upgrade to a paid plan. As of this update, our paid plans are:

  • Partner — $19/month or $190/year. Enhanced listing, contact form, monthly performance reports.
  • Premium — $59/month or $590/year. Everything in Partner, plus the brand portal frame-vault, priority placement, and unlimited photo uploads.

Plans renew automatically through Stripe until cancelled. Pricing may change with 30 days' notice; existing subscribers keep their current rate through the end of the paid period.

3. Account Responsibility

You are responsible for keeping your password and any 2FA recovery codes safe. We offer TOTP two-factor authentication and strongly recommend you turn it on. We are not liable for losses caused by a compromised account, except in cases of our own gross negligence. If you suspect unauthorized access, email andy@gazaleyewear.com immediately.

4. Acceptable Use

By using the site, you agree not to:

  • Scrape, crawl, or harvest data without written permission.
  • Make false claims about a business, person, product, or affiliation.
  • Impersonate another boutique, brand, or individual.
  • Reverse-engineer, decompile, or attempt to extract source code.
  • Upload content you do not have the rights to publish.
  • Use the site for spam, malware, or any unlawful purpose.

We may remove content or suspend accounts that violate these rules. We try to give notice first, but we reserve the right to act immediately if the violation is material.

5. Intellectual Property

You keep the rights to anything you upload — photos, descriptions, logos, store information. By uploading, you grant The View Eyewear a worldwide, non-exclusive, royalty-free license to display, distribute, and promote that content on the site and in our marketing of the site (including social posts, newsletters, and search previews).

The site itself — code, design, the View Eyewear name and logo — belongs to us. You may not copy or rebrand it.

6. Termination

You can cancel your subscription at any time through the billing portal. We can terminate or suspend an account for:

  • Violations of these Terms.
  • Fraud, chargebacks made without first contacting us, or payment fraud.
  • Payment failure that remains unresolved for 30 days or more.

On termination, paid features stop. Your free listing may remain indexed, or we may remove it at our discretion.

7. Disclaimers

The site is provided "as is." We do our best to keep listings accurate, but we do not warrant that information about a boutique, brand, frame, price, or event is current or complete. Listings are factual representations submitted by the listed party or compiled from public sources. We make no warranty of merchantability, fitness for a particular purpose, or non-infringement beyond what US law requires.

8. Limitation of Liability

To the maximum extent allowed by US law, our total liability to you for any claim arising out of your use of the site is limited to the fees you paid us in the 12 months before the claim, capped at $200. We are not liable for indirect, incidental, consequential, or punitive damages, lost profits, or lost data.

9. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules.

10. Dispute Resolution and Class Action Waiver

Any dispute that cannot be resolved by talking it out will be settled by binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association. You and we waive the right to a jury trial and the right to bring or participate in a class action. Either party may still bring a small-claims action in Georgia state court.

11. Changes to These Terms

We may update these Terms. For material changes, we will give you at least 30 days' notice by email and a banner in your dashboard. Continued use after the effective date means you accept the changes. Non-material edits (typos, clarifications) take effect when posted.
